For organizations like Project Access NOW, health coverage access means enrollment AND continuity. Ensuring that people get covered and stay covered is essential to improving health outcomes, reducing uncompensated care, and strengthening community-wide stability. Recent federal policy changes and court decisions affecting the Affordable Care Act (ACA) marketplace underscore just how fragile that continuity can be and why coordinated, community-based support is more important than ever. 

Coverage Gaps Are Real and Hard to Recover From 

One of the most important realities to understand is that losing one type of coverage (Marketplace, for example) does not automatically qualify that person for other types of coverage. These programs operate under a complex system of eligibility rules, and many individuals still fall into gaps between them. At PANOW, we know that preventing coverage loss is far more effective than trying to reconnect someone after they’ve fallen out of the system. Once an individual loses coverage, re-enrollment can be delayed by many factors including missed deadlines, documentation requirements, income fluctuations, and more. Each gap increases the risk that someone will remain uninsured longer than expected. 

New Federal Rules May Increase Financial Barriers 

 A new federal rule finalized in May 2026 introduces new risks to preserving access pathways, especially related to affordability. The rule allows insurers to offer bronze plans with out-of-pocket maximums up to 130% of the current statutory limit, potentially exceeding $15,000 annually for individuals. This shift has real implications,  increasing financial exposure for individuals who need care, even as their monthly premium costs rise simultaneously. 

For many people, this leads to “underinsurance” (they have coverage but cannot afford to use it) and can be a pathway to churn or coverage loss. Research and litigation around these policies already suggest that higher cost-sharing can lead to coverage loss and increased uncompensated care. 

Administrative Burden Still Drives Disenrollment 

Beyond cost, administrative complexity remains a major driver of coverage loss. The same regulatory environment includes increased documentation requirements and enrollment scrutiny, which can create barriers even for eligible individuals. For many communities served by Project Access NOW, these are decisive obstacles. Missed notices, incomplete paperwork, or confusion about plan requirements can quickly lead to disenrollment and health complications. In this environment, churn is often less about eligibility and more about whether someone has the support needed to navigate the system successfully. 

A Temporary Win for Continuous Coverage 

A separate June 2026 federal court ruling vacated several provisions of a controversial ACA marketplace rule that would have made enrollment and retention more difficult. The provisions struck down included: a shortened open enrollment period, stricter eligibility verification requirements, and penalties tied to re-enrollment and past-due premiums. These changes matter because each one would have increased the likelihood of administrative coverage churn, when people lose insurance not because they are ineligible, but because the system becomes harder to navigate. 

The restoration of a longer open enrollment window is especially significant. It may allow states like Oregon to maintain the  November 1 through January 15 enrollment period they have offered for several years now, giving individuals, and the organizations supporting them, more time to enroll, resolve documentation issues, and avoid gaps in coverage. 

At the same time, this progress may be temporary. Appeals are likely, and elements of similar policy changes have already been enacted through legislation, leaving the market in a state of ongoing uncertainty.
